These Terms of Service are an agreement between you and The Application LLC, a Colorado limited liability company that operates The Application (theapplication.app, thegrad.app, and theundergrad.app). By using the service, you agree to these terms.
Using The Application
The Application is a tool for tracking college and graduate school applications. By creating an account, you agree to use it for that purpose and to keep your login credentials secure.
Who can use The Application
You must be at least 18 years old to agree to these terms on your own. If you are under 18 (for example, a high-school student planning college applications on theundergrad.app), a parent or legal guardian must review these terms and agree to them on your behalf, and they are responsible for your use of the service. The Application is not directed at children under 13, and we do not knowingly allow them to create accounts.
Your account and content
You are responsible for the information you enter and for activity under your account. You retain ownership of your data; we store it to provide the service.
Payments and refunds
Some features are paid. Payments are processed by Stripe, and any applicable fees are shown before you purchase. Paid AI features may consume usage as described at the point of purchase.
All purchases are final. The Season Pass and AI credit packs are non-refundable, in full or in part, once purchased.
If you delete your account, you have 30 days to change your mind: signing back in restores your data and any remaining paid entitlement, as described in our Privacy Policy. After those 30 days everything is permanently deleted. Any remaining paid entitlement is forfeited, we can’t issue a refund, and purchases can’t be carried over to a new account if you sign up again later.
Acceptable use
Please don’t misuse the service: no attempting to access other users’ data, disrupting the platform, or using it for anything unlawful.
Availability and warranty
The Application is provided on an “as is” basis while in active development. We can’t guarantee uninterrupted availability and recommend keeping your own copies of anything critical.
Limitation of liability
The Application is a tracking tool. Admission decisions are made by schools, not by us, and we are not responsible for the outcome of any application, including outcomes affected by the information, deadlines, or AI-generated suggestions shown in the app. Always confirm deadlines and requirements against the school’s own materials.
To the fullest extent permitted by law, The Application LLC will not be liable for indirect, incidental, special, or consequential damages, such as missed deadlines, lost opportunities, or lost data, arising from your use of the service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim arose or $100. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.
Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules.
Changes to these terms
We may update these terms as the product evolves. Material changes will be reflected in the “last updated” date above.
